YOU MAY OPT OUT WITHIN 30 DAYS OF FIRST ACCEPTANCE. SEE SECTION 11.

1. Acceptance of Terms

Grant Search US (doing business as "Grant Search International™") is the legal entity that operates this Platform. References to "Grant Search US" or "Grant Search International™" throughout this document refer to the same legal entity.

By accessing or using the Grant Search US platform ("Platform" or "Services"), you agree to be bound by these Terms & Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Grant Search US. If you do not agree, do not access or use the Platform.

AGE REQUIREMENT — PLATFORM NOT DIRECTED AT MINORS: Grant Search US is intended SOLELY for users who are at least 18 years old or the age of legal majority in their jurisdiction. This Platform is NOT directed at minors under 18. We do not knowingly collect personal information from users under 18. By creating an account, you explicitly confirm: "I am at least 18 years old, I have the legal authority to enter into this agreement, and I am not a minor." If you are under 18, you may not use this Platform under any circumstances. This age restriction applies to all features, including grant discovery, AI drafting tools, and application workflows.

ELECTRONIC AGREEMENT: By clicking "I Agree," checking any acceptance box, or otherwise using the Services, you agree that these Terms form an enforceable electronic contract under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001, and applicable state Uniform Electronic Transactions Act (UETA) laws. You consent to receive disclosures and communications electronically.

2. Description of Service — Software Tool, Not Consulting

Grant Search US provides AI-powered grant discovery, eligibility analysis, application drafting assistance, budget planning tools, and competitive research tools (collectively, the "Services"). The Platform is a productivity and discovery tool — it is not a grant agency, legal advisor, financial advisor, or professional grant writer.

SOFTWARE TOOL — NOT CONSULTING SERVICES: Grant Search US provides AI-powered software tools only. We are not a grant consulting firm, grant writing service, grant agency, or professional grant consultant. We do not provide professional grant consulting services as defined under any state or federal law, including but not limited to the New York Arts & Cultural Affairs Law § 25.03, Massachusetts nonprofit consulting requirements, or the Illinois Charitable Solicitation Act. No employee, contractor, or AI system of Grant Search US acts as your grant consultant, grant writer, or authorized representative to any funding agency. All content generated by Grant Search US AI tools requires your own independent review, editing, and verification before use. You are solely responsible for all content you submit to any funder.

Nothing on this Platform constitutes legal, financial, tax, or professional advice of any kind. AI-generated content may contain inaccuracies, hallucinations, or outdated information. You are solely responsible for reviewing, verifying, and editing all content before submitting it to any grant funder. Grant approval is never guaranteed by Grant Search US.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and truthful account information at all times. • Notify us immediately of any unauthorized access or security breach at support@grantsearchus.com. • Maintain a single account per individual and not create multiple accounts to circumvent usage limits. • Not share your account credentials with any third party. • Not allow any other person or entity to access the Platform using your credentials.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice, at our sole discretion.

3a. AI Service Credits — No Cash Value

Grant Search US "credits" (also referred to as "AI credits" or "AI service credits") are non-monetary, non-redeemable, non-transferable units of access to Grant Search US AI features. They are provided solely as a mechanism for measuring and limiting feature usage within the Grant Search US platform.

CRITICAL DISCLAIMERS — PLEASE READ:

• Credits have NO cash value, monetary value, or exchange value of any kind. • Credits are NOT a stored-value instrument, prepaid card, gift card, or money equivalent under the Electronic Fund Transfer Act (15 U.S.C. § 1693 et seq.) or any state money transmission law. • Credits are NOT redeemable for cash, cryptocurrency, goods, or services outside the Grant Search US platform. • Credits are NOT transferable between unaffiliated accounts. Team plan allocations within a single organizational subscription are internal administrative distributions, not monetary transfers. • Credits expire as described in your plan terms and have no residual value upon expiration or account closure. • Grant Search US is NOT a money services business (MSB), money transmitter, or payment intermediary. The credit system qualifies for exemptions under 31 CFR § 1010.100(ff)(5)(ii)(F) ("integral to services" exemption) and the closed-loop prepaid access exclusion under 31 CFR § 1010.100(ff)(4)(iii)(A). • Credits do not constitute "stored value" under the Electronic Fund Transfer Act, the Bank Secrecy Act, or any state money transmitter law.

Refunds, where applicable under Section 6, are refunds of subscription fees — not redemptions of credit value.

4. Subscriptions & Billing — Auto-Renewal Disclosure (State ARL Compliance)

IMPORTANT AUTO-RENEWAL NOTICE (Required by California Business & Professions Code §§ 17600–17606 as amended by AB 2863 effective July 1, 2025, New York GBL § 527, Illinois Automatic Contract Renewal Act, Virginia Code § 59.1-207.45, Colorado HB 21-1239, and the Restore Online Shoppers' Confidence Act (ROSCA), 15 U.S.C. § 8401 et seq.):

NOTE ON FTC NEGATIVE OPTION RULE: The FTC's amended Negative Option Rule (16 CFR Part 425), known as the "Click-to-Cancel Rule," was vacated by the U.S. Court of Appeals for the Eighth Circuit on July 8, 2025, on procedural grounds. However, the underlying ROSCA statute (15 U.S.C. § 8401 et seq.) remains in effect, and the FTC continues to enforce negative option practices under Section 5 of the FTC Act (15 U.S.C. § 45). Additionally, state automatic renewal laws—including California's ARL as amended by AB 2863 (effective July 1, 2025), which explicitly requires a "click to cancel" button for online subscriptions—remain fully enforceable. Grant Search US complies with all applicable state ARLs regardless of the status of the FTC rule.

ALL RECURRING SUBSCRIPTION PLANS AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD AT THE THEN-CURRENT RATE UNLESS YOU CANCEL BEFORE THE RENEWAL DATE. BY COMPLETING YOUR PURCHASE, YOU AFFIRMATIVELY AUTHORIZE Grant Search US TO CHARGE YOUR PAYMENT METHOD ON A RECURRING BASIS WITHOUT FURTHER AUTHORIZATION UNTIL YOU CANCEL.

Grant Search US offers the following subscription tiers:

• Free Plan — Limited AI credits, basic grant discovery. • Starter Plan — Recurring monthly billing at $14.99/month (or current price shown at checkout). • Pro Monthly — Recurring monthly billing at $39.99/month (or current price shown at checkout), unlimited AI access. • Pro Annual — Recurring annual billing at $299/year (or current price shown at checkout), unlimited AI access. • Lifetime Plan — One-time payment of $599 (or current price shown at checkout), permanent full access, no recurring charges. • Team Plan — Recurring monthly or annual billing for up to 5 seats. • Institutional Plan — Recurring monthly or annual billing for up to 25 seats. • Enterprise Plan — Custom pricing. Contact sales.

All prices are in USD. Current prices are always displayed at checkout and on the Pricing page. Prices are subject to change with 30 days' prior notice to subscribers.

PRE-RENEWAL NOTICE: For annual plans, we will send a reminder email to the address on file at least 7 days before your renewal date specifying the renewal amount and renewal date. You may cancel before that date to avoid renewal charges.

CANCELLATION: You may cancel at any time before the renewal date through: (a) your Profile page → Subscription tab; (b) the Cancel Subscription page (accessible from the site footer); or (c) by contacting support. Cancellation is effective immediately — you retain access through the end of your current paid period. No further charges will occur after cancellation. Canceling does not delete your account or data. See Section 5 for full cancellation details.

We use a secure third-party payment processor. We do not store your full payment card number or CVV on our servers.

Team and Institutional plans are billed to a single account holder (the "Team Admin"). The Team Admin is responsible for all charges, seat management, and compliance with these Terms by all seat users. Enterprise plans are billed to the designated organizational account holder.

5. Cancellation Policy

You may cancel your subscription at any time through:

(a) Your Profile page — navigate to Profile → Subscription tab. (b) The Cancel Subscription page, accessible from the site footer. (c) Contacting support via the Support page.

Cancellation is immediate — once you confirm cancellation, no further charges will occur. You retain full access to paid features through the end of your current billing period. After that, your account reverts automatically to the free plan. Cancellation does not delete your account or your saved data. Deleting your account does not automatically cancel your subscription — these are separate actions.

CALIFORNIA RESIDENTS: Under California Business & Professions Code § 17602, you have the right to cancel this subscription at any time. The cancellation mechanism described above is available 24/7 and requires no phone call, email, or engagement with a customer service representative.

NO DARK PATTERNS: Grant Search US does not use dark patterns, guilt-based UI, or hidden steps in the cancellation flow. The "Cancel Subscription" button leads directly to a confirmation screen with no mandatory retention flow.

No partial-period refunds are issued upon cancellation, except as described in Section 6 (Win or Refund Guarantee) or where required by applicable law (including California, where subscriptions treated as gifts upon non-compliant cancellation processes may trigger refund obligations).

6. Win or Refund Guarantee & Refund Policy

Grant Search US offers a Win or Refund Guarantee (individual plans) and a Success Commitment (Team & Institutional plans) on qualifying paid subscriptions. Full terms are detailed on the Guarantee Terms & Conditions page.

Individual Plans (Starter, Pro Monthly, Pro Annual, Lifetime) — Win or Refund Guarantee: Eligibility — You must: (a) hold an active paid individual subscription; (b) submit exactly two (2) complete, AI-assisted grant applications through Grant Search US within 3 months — submitting fewer than 2 or more than 2 disqualifies you; (c) receive documented denials for both; (d) submit your refund request within 30 days of the final decision; AND (e) have consumed 20% or fewer of your plan's AI credits at the time of the request.

Refund Amount — Qualifying refunds cover subscription fees paid during the 3-month guarantee window. Add-on purchases, credit top-up packs, and AI-generated content already delivered are non-refundable.

Team & Institutional Plans — Success Commitment: In lieu of a cash refund, Team and Institutional subscribers who submit the required minimum applications (3 for Team, 5 for Institutional) within 3 months and receive no awards may claim a free renewal year credited to their account. NO CASH REFUND IS AVAILABLE for Team or Institutional plans once any AI credits have been consumed by any seat member.

AI Content License Upon Refund: All AI-generated content produced through Grant Search US tools is provided under a non-exclusive, perpetual, irrevocable license. You retain the right to use, edit, and submit all AI-generated content created during your subscription for any grant applications, regardless of whether a refund is issued. Grant Search US retains underlying intellectual property in its AI systems, prompt engineering, and methodologies — not in the specific content generated for you. Issuance of a refund does not diminish or extinguish your license to content already generated.

CHARGEBACK POLICY: By purchasing a Grant Search US subscription, you acknowledge that the guarantee process described herein is your exclusive contractual remedy for dissatisfaction with the Services prior to initiating any payment reversal. Initiating a chargeback or payment reversal with your bank or card issuer without first completing the guarantee request process and receiving a final determination constitutes a breach of these Terms. Grant Search US reserves the right to contest chargebacks with full documentation and to permanently suspend accounts that initiate bad-faith chargebacks. This policy does not waive your rights under applicable consumer protection law or your rights with your card issuer.

Processing — Approved individual refunds are issued within 5–7 business days. Approved team credits are applied within 5 business days. See the full Guarantee Terms & Conditions page for complete eligibility criteria.

6a. Lifetime Plan — Availability Contingent on Platform Operation

The Lifetime Plan provides continued access to the features included at the time of purchase for as long as the Grant Search US platform remains in operation. The following terms apply specifically to Lifetime accounts:

AVAILABILITY CONTINGENCY: "Lifetime" means the duration of the Grant Search US platform's operation — not the lifetime of the user, not perpetuity, and not a guarantee of indefinite service. You acknowledge that any online software platform may be discontinued, suspended, wound down, or sold, and that Lifetime access is valid only for so long as Grant Search US continues to operate the Platform in its sole discretion.

NO REFUND UPON PLATFORM DISCONTINUATION: In the event that Grant Search US discontinues, winds down, suspends, or ceases operation of the Platform for any reason — including but not limited to business closure, acquisition, insolvency, regulatory action, or force majeure — no refund, partial refund, credit, or compensation of any kind will be issued to Lifetime members for unused access or unused credits. By purchasing the Lifetime Plan, you explicitly acknowledge and accept this risk.

CREDIT BANK & USAGE: Lifetime credits (2,000) are a one-time bank that does not refresh. Unused credits carry forward indefinitely while the Platform operates but have no cash or residual value (see Section 3a) and are forfeited without refund if the Platform ceases operation.

FUTURE FEATURES: "All future features included" means features we choose to release to Lifetime members at our discretion; we are not obligated to develop any specific future feature, and the scope of Lifetime access is limited to the features generally available to paid members at the time of use.

CAP & PRICE CHANGES: Grant Search US may limit the total number of Lifetime accounts sold (for example, to the first 2,000 members) and may increase the Lifetime price, close Lifetime to new members, or withdraw the Lifetime offering at any time, without notice, at our sole discretion. These changes do not affect existing Lifetime members' access while the Platform operates, except as stated in the Availability Contingency above.

This Section 6a is in addition to, and does not replace, the refund terms in Section 6. The 48-hour grace-period refund described in Section 6 is the only refund available for the Lifetime Plan, and is available only if no credits have been used within 48 hours of purchase.

7. AI-Generated Content, Deadline Accuracy & Disclaimer

AI-generated content and tool outputs provided through the Platform are AI estimates for planning purposes only.

DEADLINE ACCURACY DISCLAIMER — CRITICAL: Grant application deadlines displayed on Grant Search US are sourced from a combination of verified government APIs (Grants.gov, SAM.gov, NIH Reporter, NSF) and AI-estimated data. Deadlines marked "⚠️ Unverified" or lacking a verified-source badge are AI-estimated and may be inaccurate, outdated, or entirely fabricated by the AI model. ALWAYS verify the official deadline directly on the funder's official website before submitting any application. Grant Search US makes no warranty of any kind — express or implied — regarding the accuracy, completeness, or timeliness of any grant deadline. Missing a grant deadline due to reliance on Grant Search US deadline data is not grounds for a refund.

AI HALLUCINATION WARNING: Large language models (LLMs) can and do generate content that appears authoritative but is factually incorrect — a phenomenon known as "hallucination." All statistics, funding amounts, eligibility criteria, program descriptions, and factual claims generated by Grant Search US AI tools must be independently verified against primary sources before you rely on or submit them. Grant Search US does not warrant the accuracy of any AI-generated factual claim.

You are solely responsible for: • Reviewing, editing, and verifying all AI-generated content before submission. • Ensuring your application content is accurate and truthful. • Checking whether the grant program permits or requires disclosure of AI-assisted submissions. • Verifying all statistics, program data, and eligibility criteria independently.

Grant Search US is not liable for grant rejections, funding losses, missed deadlines, or any outcome arising from your use of AI-generated content.

7a. No Guarantee of Grant Funding — Critical Disclaimer

Grant Search US is a SOFTWARE TOOL that assists with grant discovery, drafting, and management. Under NO circumstances does Grant Search US guarantee, promise, or warrant that any user will win, be awarded, or receive any grant, funding, or financial award of any kind.

NO GUARANTEE OF FUNDING: You acknowledge and agree that:

• Grant funding decisions are made solely by funding organizations (government agencies, foundations, corporations) — NOT by Grant Search US.

• Grant Search US has NO influence, control, or authority over any funding decision made by any grant-making organization.

• The outcome of any grant application depends on factors entirely outside Grant Search US's control, including but not limited to: the quality of your organization, the competitiveness of your application, the number of applicants, the funder's budget, the funder's priorities, and the merit of competing applications.

• Grant Search US provides TOOLS — not outcomes. Using this platform does not increase, guarantee, or promise any probability of winning grants.

• Any marketing claims regarding win rates, success rates, or outcomes refer to user survey data and internal analytics, are qualified with "results vary" language, and do not represent a guarantee of individual results.

• The Win or Refund Guarantee (Section 6) is a SATISFACTION COMMITMENT — it provides a refund if you meet specific eligibility criteria and are dissatisfied. It is NOT a guarantee that you will win grants.

BY PURCHASING A SUBSCRIPTION, YOU EXPLICITLY ACKNOWLEDGE THAT GRANT SEARCH US DOES NOT GUARANTEE ANY GRANT FUNDING OUTCOME, and you agree that the absence of grant awards is not grounds for a claim of breach of contract, fraud, misrepresentation, or any other cause of action against Grant Search US.

This disclaimer is in addition to, and does not replace, the disclaimers in Sections 2, 7, and 10.

7b. Acceptable Use & Subscription Integrity — Automated Monitoring

Your subscription to Grant Search US is licensed for individual use unless you have purchased a Team, Institutional, or Enterprise plan with multiple seats. Sharing your subscription credentials, AI credits, or platform access across multiple organizations, or allowing multiple individuals to use a single-user subscription, is a material breach of these Terms.

PROHIBITED CONDUCT: You agree NOT to: • Share your login credentials, password, or account access with any other person or organization. • Use a single-user subscription to produce grant content for multiple distinct organizations. • Allow concurrent access to your account from multiple users simultaneously. • Transfer or resell your subscription access to third parties. • Circumvent usage limits by creating multiple accounts or rotating credentials.

AUTOMATED MONITORING CONSENT: You acknowledge and agree that Grant Search US may use automated monitoring systems — including AI-based analysis of credit usage patterns, login geography, device fingerprints, session timing, and usage velocity — to detect subscription sharing or account abuse. This monitoring is performed on aggregated, anonymized usage metadata and does not involve review of your specific grant content. Your continued use of the Platform constitutes consent to this monitoring.

ENFORCEMENT LADDER: Violations of this Section 7b are enforced through the following escalating tiers:

7b.1 — Tier 1 (Warning): Automated warning email notifying you of detected unusual activity. No account restrictions.

7b.2 — Tier 2 (Formal Notice): Formal notice requiring you to either (a) upgrade to a Team or Institutional Plan, (b) secure your account, or (c) appeal. You have 7 days to comply.

7b.3 — Tier 3 (Suspension): Your AI credits are frozen and paid features are disabled. You may request reinstatement by upgrading to a multi-seat plan or demonstrating that the alert was a false positive.

7b.4 — Tier 4 (Cancellation): Your subscription is immediately canceled via our payment processor. Per Section 8.3(e) of these Terms, NO REFUND is available for subscriptions terminated for cause due to subscription sharing or account abuse. Your account is downgraded to the free plan.

NO-REFUND POLICY FOR ABUSE TERMINATION: You expressly acknowledge that termination of your subscription under this Section 7b constitutes termination for cause. Per Section 8.3(e), fees paid for the billing period in which termination occurs are non-refundable. This no-refund policy does not affect your statutory consumer rights where applicable law prohibits such exclusions.

FALSE POSITIVE APPEAL: If you believe an enforcement action was taken in error, you may appeal by contacting support. Appeals are reviewed within 5 business days. Legitimate heavy users (e.g., full-time grant writers) will not be penalized for high usage within a single organization.

This Section 7b is in addition to, and does not replace, the account responsibilities in Section 3 and the prohibited uses in Section 9.

8. Intellectual Property & AI Improvement Program

All Platform content, branding, software, grant database compilations, and tools are the intellectual property of Grant Search US and are protected by applicable copyright, trademark, and trade secret laws. The following innovations are protected as confidential trade secrets under the Defend Trade Secrets Act (DTSA), 18 U.S.C. §§ 1836–1839:

• System and Method for Multi-Reviewer Grant Application Evaluation • Competitive Grant Analysis Using Historical Success Patterns • Intelligent Grant Recommendation Engine

The Grant Search US name, logo, and distinctive branding are protected under common law trademark rights pending USPTO registration. You may not use the Grant Search US name or marks in any way that creates confusion about sponsorship, endorsement, or affiliation.

You may not copy, scrape, resell, or republish our grant database or platform content without written consent. Unauthorized scraping or database redistribution may violate the Computer Fraud and Abuse Act (CFAA), 18 U.S.C. § 1030, and applicable copyright law.

AI-Generated Content — License, Not Sale: All AI-generated content produced through Grant Search US tools is provided under a non-exclusive, perpetual, irrevocable license for your own personal and organizational grant-seeking purposes. Grant Search US retains intellectual property rights in its AI systems, prompt engineering, methodologies, and platform architecture — not in the specific text generated for your individual use. Consuming AI credits constitutes acceptance that the AI service has been delivered. This license survives account closure or any refund.

8a. Your Own Input Content: Grant drafts, narratives, and documents you create using your own original words and upload to the platform belong to you. You grant Grant Search US a limited, non-exclusive, royalty-free license to store and process your content solely to provide the Services to you. By default, we do not use your application content for any purpose other than delivering the Services to your account.

8b. Autonomous AI Draft Coaching (Phase 1 — All Paid Users): Our automated AI systems periodically review your in-progress application drafts to generate personalized writing coaching and improvement suggestions delivered to your account. This review is performed solely to improve your individual experience. No content is shared with other users, used to train AI models, or stored outside your account without your explicit consent as described in Section 8c.

8c. Optional AI Improvement Program (Phase 2 — Opt-In Only): If you choose to participate in our AI Improvement Program (available as an opt-in setting in your Profile), you grant Grant Search US an additional limited license to use anonymized, aggregated structural patterns derived from your application content — with all personally identifiable information removed — to improve the platform's AI quality for all users. You may withdraw consent at any time by toggling off "Help Improve AI Drafting" in Profile settings. Withdrawal applies prospectively. This opt-in constitutes your explicit written consent as required by CCPA, GDPR, and applicable state privacy laws.

8b. FERPA — Student Education Records

Grant Search US serves users in education-related fields including PreK-12, Higher Education, and Trade Schools. If you are an educator, administrator, researcher, or institution applying for education grants, you may be subject to the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g, and related state student privacy laws.

FERPA DISCLAIMER AND USER OBLIGATION:

Grant Search US is NOT a school official, education agency, or authorized FERPA-covered entity and does not have a legitimate educational interest in student education records. You must NOT upload, enter, or share any student education records — including but not limited to:

• Student names, student ID numbers, or other student identifiers • Academic records, grades, transcripts, or enrollment information • Disciplinary records or behavioral data related to specific students • Individualized Education Program (IEP) data or special education records • Any other information directly tied to an identifiable student

You are solely responsible for ensuring your use of Grant Search US complies with FERPA, the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq., and all applicable state student privacy laws. Do not submit student education records — use aggregate, anonymized, or de-identified data instead.

Grant Search US shall not be liable for any FERPA violation, regulatory action, or loss of federal funding eligibility resulting from your uploading or entering student education records through this platform.

8c. Federal Grant Applications — False Statements Warning

IMPORTANT LEGAL NOTICE FOR USERS SUBMITTING FEDERAL GRANT APPLICATIONS:

Grant Search US AI tools generate draft content for your review. You are solely responsible for the accuracy of any grant application you submit to a federal agency.

• VERIFY ALL STATISTICS AND NUMERICAL CLAIMS: AI-generated statistics, outcome percentages, budget figures, and organizational data must be independently verified against your actual records before submission.

• SUBMITTING FALSE STATEMENTS IS A FEDERAL CRIME: Under 18 U.S.C. § 1001, knowingly submitting false or fraudulent statements to a federal agency is a criminal offense punishable by up to 5 years imprisonment per count.

• FALSE CLAIMS ACT: Under 31 U.S.C. § 3729, submitting false or fraudulent claims to the federal government may result in civil liability of three times the damages sustained by the government, plus civil penalties of $13,946–$27,894 per false claim (2024 adjusted amounts). Private individuals may file qui tam lawsuits and recover 15–30% of the government's recovery.

• NO AI DEFENSE: The fact that a statistic or claim was generated by AI does not constitute a defense to a false statements prosecution or False Claims Act liability. You must verify every factual representation before submitting.

Grant Search US is not liable for any false statements, misrepresentations, or fraudulent claims contained in applications you submit. You indemnify Grant Search US against any claims, investigations, or penalties arising from the content of your submissions.

8d. PDF Processing — Temporary Form-Filling Only

Grant Search US provides AI-powered PDF form auto-filling as a convenience feature. By uploading PDF documents for processing, you agree to the following terms:

PDF PROCESSING DISCLAIMER — CRITICAL: • TEMPORARY PROCESSING ONLY: Uploaded PDFs are processed transiently for form-filling purposes only. Files are deleted from our processing servers within 24 hours of completion. • NO STORAGE OR SHARING: We do not store, retain, share, sell, or otherwise disclose your uploaded PDF content to third parties beyond what is necessary to provide the form-filling service. • USER RESPONSIBILITY: You represent and warrant that you have the legal right to upload and process all PDF documents submitted through the Platform. You are solely responsible for ensuring your PDFs do not violate any third-party copyrights, contain prohibited content, or violate applicable laws. • NO GUARANTEE OF ACCURACY: AI-generated field values are estimates only. You must review and verify all auto-filled content before downloading, signing, or submitting any form. Grant Search US makes no warranty regarding the accuracy, completeness, or suitability of auto-filled PDF content. • PROHIBITED USES: You may not use the PDF auto-fill feature to process documents containing classified information, protected health information (PHI) subject to HIPAA, student education records subject to FERPA, or any other legally restricted content.

This feature uses Base44's PDF processing infrastructure with enterprise-tier security (TLS 1.3 encryption in transit, AES-256 encryption at rest). Your PDF content is processed in accordance with Section 4a of our Privacy Policy.

8e. Referral Program — FTC Endorsement Disclosure (16 CFR Part 255)

Grant Search US operates a referral program under which users may earn platform credits when referred users sign up and complete qualifying actions. Platform credits have no cash value (see Section 3a).

FTC DISCLOSURE REQUIREMENT: Under FTC Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 CFR Part 255, as updated 2023), anyone who receives material compensation — including credits that reduce future costs — for recommending a product or service must clearly and conspicuously disclose that relationship to recipients.

YOUR OBLIGATION WHEN SHARING A REFERRAL LINK: If you share your Grant Search US referral link in any communication (email, social media, text message, blog post, video, or any other medium), you must include a clear disclosure such as:

"Disclosure: I may earn platform credits if you sign up through my link."

Grant Search US automatically includes this disclosure in all share buttons and pre-composed share text within the platform. However, if you manually copy and share your referral link outside these tools, you are solely responsible for including the required disclosure.

Failure to include the required disclosure when sharing a referral link may expose you (not Grant Search US) to FTC enforcement action. Grant Search US is not liable for any regulatory action arising from your failure to provide required endorsement disclosures.

9. Prohibited Use & Grant Data Restrictions

You agree not to use the Platform to:

• Submit fraudulent grant applications or misrepresent your organization's eligibility, size, or nonprofit status. • Scrape, copy, or redistribute our grant database for commercial resale or to build a competing product. • Circumvent usage limits by creating multiple accounts or sharing account credentials. • Deploy automated bots, scrapers, or scripts against our platform without authorization. • Violate any applicable local, state, national, or international laws or regulations. • Upload malware, viruses, or malicious code. • Harass, threaten, or impersonate other users or Grant Search US staff. • Use the platform in connection with any fraudulent grant scheme, identity fraud, or federal program abuse.

9a. Grant Data — No Scraping, Re-Export, or Downstream Redistribution

The grant opportunity data displayed on this Platform is compiled from public and licensed sources, including Grants.gov, SAM.gov, USASpending.gov, NIH Reporter, NSF Award Search, ProPublica Nonprofit Explorer, IRS Form 990 filings, and various state and private foundation portals. Each of these sources has its own Terms of Use governing downstream use.

You expressly agree that you will NOT:

• Scrape, harvest, crawl, or systematically extract grant data from the Platform via any automated means. • Re-export, download in bulk, or redistribute grant data to any third party, external database, or competing service. • Use grant data accessed through this Platform to build, train, or populate a competing grant database or tool. • Resell, sublicense, or commercially exploit grant data obtained through this Platform. • Circumvent any technical measures designed to prevent bulk extraction of grant data.

Permitted Use: You may access, view, save, bookmark, and apply to individual grant opportunities for your own organization's grant-seeking purposes.

Violations of this Section may result in immediate account termination, injunctive relief, and claims under the Computer Fraud and Abuse Act (18 U.S.C. § 1030), the DMCA, applicable state computer access laws, and/or breach of contract. Grant Search US expressly reserves the right to seek statutory and actual damages for violations of this Section.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Grant Search US SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING BUT NOT LIMITED TO GRANT REJECTIONS, FUNDING LOSSES, LOST PROFITS, MISSED DEADLINES, OR LOSS OF DATA.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO Grant Search US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

DISCLAIMER OF WARRANTIES: THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR COMPLETENESS. Grant Search US DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

EXCLUSION OF CONSEQUENTIAL AND INCIDENTAL DAMAGES: IN NO EVENT SHALL Grant Search US BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DAMAGES FOR: (i) LOSS OF GRANT FUNDING OR GRANT OPPORTUNITIES; (ii) LOSS OF REVENUE, INCOME, OR PROFITS; (iii) LOSS OF BUSINESS OR BUSINESS OPPORTUNITY; (iv) LOSS OF DATA OR CORRUPTION OF DATA; (v) MISSED DEADLINES OR APPLICATION WINDOWS; (vi) DAMAGE TO REPUTATION OR GOODWILL; (vii) EMOTIONAL DISTRESS OR MENTAL ANGUISH; OR (viii) ANY OTHER SIMILAR DAMAGE ARISING IN ANY WAY FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF Grant Search US HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

EXCLUSION OF THIRD-PARTY CLAIMS: Grant Search US shall not be liable for any claims, damages, or liabilities arising from the actions or omissions of third parties, including but not limited to funding organizations, grant reviewers, payment processors, or any other third-party service provider.

NO LIABILITY FOR FUNDING DECISIONS: Grant Search US has no control over, and bears no responsibility for, any decision made by any funding organization, government agency, foundation, corporation, or other grant-making entity. You acknowledge that all funding decisions are made solely by such entities and that Grant Search US has no ability to influence, appeal, or reverse any such decision.

NO LIABILITY FOR AI-GENERATED CONTENT: You acknowledge that AI-generated content may contain errors, hallucinations, or inaccurate information. Grant Search US is not liable for any damages arising from your use, reliance on, or submission of AI-generated content. You are solely responsible for reviewing and verifying all AI-generated content before use.

NO LIABILITY FOR THIRD-PARTY INTEGRATIONS: Grant Search US is not liable for any damages arising from the use of third-party integrations, connectors, or services, including but not limited to Google Drive, Google Sheets, Salesforce, HubSpot, Slack, Microsoft Teams, Outlook, DocuSign, Zapier, or any other third-party service. Your use of such integrations is subject to the terms of service and privacy policies of those respective providers.

LIMITATION OF LIABILITY FOR FREE USERS: If you are using the free plan and have not paid any fees to Grant Search US, you acknowledge that Grant Search US's liability to you is limited to the maximum extent permitted by law, and in no event shall exceed fifty U.S. dollars ($50.00).

Some jurisdictions do not allow the exclusion of implied warranties or limitation of incidental/consequential damages, so some of the above limitations may not apply to you. In those jurisdictions, our liability is limited to the maximum extent permitted by applicable law.

NEW JERSEY RESIDENTS: Certain provisions of these Terms, including limitations on implied warranties and exclusions of certain damages, may not apply to New Jersey residents under the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act (TCCWNA), N.J. Stat. Ann. § 56:12-14 et seq.

SURVIVAL: The limitations and exclusions of liability in this Section 10 shall survive termination or expiration of these Terms and shall apply regardless of the legal theory asserted, whether in contract, tort (including negligence), strict liability, or any other theory.

11. Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Governing Law. These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, except where preempted by federal law.

Informal Resolution First. Before filing any claim, both parties agree to attempt resolution through good-faith written negotiation for at least 60 days. You must send a written notice of dispute to Grant Search US via our Support page describing the nature and basis of the claim and the relief sought. Grant Search US will respond within 30 days.

Binding Arbitration. EXCEPT FOR SMALL CLAIMS COURT MATTERS AND INJUNCTIVE RELIEF FOR IP VIOLATIONS, YOU AGREE THAT ANY DISPUTE, CONTROVERSY, OR CLAIM BETWEEN YOU AND Grant Search US (WHETHER IN CONTRACT, TORT, STATUTE, OR OTHERWISE) ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) UNDER ITS CONSUMER ARBITRATION RULES (AVAILABLE AT WWW.ADR.ORG). THE ARBITRATION WILL TAKE PLACE IN ORANGE COUNTY, CALIFORNIA OR VIA VIDEO/TELEPHONE AT YOUR OPTION. THE CONSUMER ARBITRATION FILING FEE IS GOVERNED BY THE AAA FEE SCHEDULE; FOR CLAIMS UNDER $10,000, THE FILING FEE IS CAPPED AT $250 WITH Grant Search US PAYING THE REMAINDER OF ARBITRATION FEES. THE ARBITRATOR'S AWARD SHALL BE FINAL AND BINDING AND MAY BE ENTERED AS A JUDGMENT IN ANY COURT OF COMPETENT JURISDICTION.

SCOPE OF ARBITRATION: This arbitration agreement applies to ALL disputes between you and Grant Search US, including but not limited to: (i) claims arising from your subscription or billing; (ii) claims arising from AI-generated content or platform outputs; (iii) claims arising from missed deadlines or failed grant applications; (iv) claims arising from data loss or service interruptions; (v) claims arising from third-party integrations or connectors; (vi) claims of fraud, misrepresentation, or fraudulent inducement (except that no arbitration shall be required for claims that are deemed non-arbitrable as a matter of law); (vii) claims regarding privacy, data security, or data breaches; (viii) claims regarding intellectual property; and (ix) any other claim arising from or relating to your use of the Services.

Class Action Waiver. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All claims must be brought in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate claims of multiple claimants or otherwise preside over any class or representative proceeding. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND Grant Search US EACH WAIVE ANY RIGHT TO A CLASS ACTION OR CLASS-WIDE ARBITRATION. NO ARBITRATION OR LAWSUIT SHALL BE CONSOLIDATED WITH ANY OTHER ARBITRATION OR LAWSUIT WITHOUT THE WRITTEN CONSENT OF ALL PARTIES.

Representative Action Waiver (California): You waive your right to bring a representative action under the California Private Attorneys General Act (PAGA) to the extent permitted by law.

NO JURY TRIAL: TO THE EXTENT ANY DISPUTE IS NOT SUBJECT TO ARBITRATION AND PROCEEDS IN COURT, YOU AND Grant Search US KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY LITIGATION ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES.

WAIVER OF CERTAIN DAMAGES: IN ANY DISPUTE, NEITHER PARTY SHALL BE ENTITLED TO RECOVER PUNITIVE, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR INDIRECT DAMAGES, AND EACH PARTY WAIVES ANY RIGHT TO RECOVER SUCH DAMAGES, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

ATTORNEYS' FEES: In any arbitration or litigation arising from these Terms, each party shall bear its own attorneys' fees and costs, except as otherwise provided by the AAA Consumer Arbitration Rules or applicable law. Grant Search US reserves the right to recover its attorneys' fees and costs if the arbitrator or court determines that your claim was frivolous, brought in bad faith, or intended to harass.

Opt-Out. You may opt out of this arbitration agreement by sending written notice to Grant Search US via the Support page within 30 days of first accepting these Terms. Opting out does not affect any other provisions of these Terms.

Small Claims. Either party may bring an individual claim in small claims court for disputes within that court's jurisdiction, provided the claim remains on an individual basis.

Mass Filing Coordination: If 25 or more claimants file demands for arbitration raising similar claims against Grant Search US, the AAA's Mass Arbitration Supplementary Rules will apply. Grant Search US and claimants will cooperate to batch similar claims and reduce duplicative filing fees.

California Public Injunctive Relief. Notwithstanding the foregoing, claims for public injunctive relief under California law may be brought in court.

VENUE: For any claim not subject to arbitration, you agree that the exclusive venue for any such claim shall be the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.

Severability. If any part of this arbitration provision is found unenforceable, that part will be severed and the remaining provisions will remain in full force. If the class action waiver is found unenforceable, the entire arbitration agreement shall be null and void, but the remaining provisions of these Terms shall survive.

GOVERNING LAW SAVINGS CLAUSE: Nothing in this arbitration agreement prevents you from filing a complaint with the Consumer Financial Protection Bureau (CFPB), Federal Trade Commission (FTC), state attorney general, or any other federal or state consumer protection authority.

SHORTENED STATUTE OF LIMITATIONS: YOU AGREE THAT ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, EXCEPT FOR CLAIMS OF INTELLECTUAL PROPERTY INFRINGEMENT, WHICH MUST BE COMMENCED WITHIN THE APPLICABLE STATUTORY PERIOD. A CLAIM OR CAUSE OF ACTION THAT IS NOT COMMENCED WITHIN THIS ONE-YEAR PERIOD IS PERMANENTLY BARRED. THIS LIMITATIONS PERIOD APPLIES TO ALL CLAIMS, WHETHER IN ARBITRATION OR COURT, AND REGARDLESS OF THE LEGAL THEORY ASSERTED. SOME JURISDICTIONS MAY NOT ALLOW CONTRACTUAL SHORTENING OF THE STATUTE OF LIMITATIONS; IN THOSE JURISDICTIONS, THE APPLICABLE STATUTORY PERIOD APPLIES.

EFFECTIVE DATE: This arbitration agreement applies to all disputes arising on or after the date you first accept these Terms, regardless of when the dispute arose.

12. Indemnification

You agree to defend, indemnify, and hold harmless Grant Search US, Inc., its officers, directors, employees, contractors, licensors, agents, successors, and assigns from and against any and all claims, lawsuits, demands, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:

(i) your use of or inability to use the Services; (ii) your violation of these Terms or any applicable law, regulation, or third-party rights; (iii) your misuse of AI-generated content, including but not limited to submitting, publishing, or distributing AI-generated content without review, verification, or appropriate disclosure; (iv) false, misleading, or fraudulent information you provide to Grant Search US or to any grant funder, government agency, or other third party, whether generated by AI or otherwise; (v) any false, fraudulent, or misleading grant application, report, or certification submitted using the platform; (vi) your violation of FERPA, COPPA, HIPAA, or other privacy laws caused by data you upload to or process through the platform; (vii) your infringement or misappropriation of any third party's intellectual property, privacy, or other rights; (viii) any content you submit, upload, transmit, or display through the platform; (ix) your failure to include required FTC endorsement disclosures when sharing referral links; or (x) any breach of your representations, warranties, or obligations under these Terms.

You agree to promptly notify Grant Search US of any claim subject to indemnification, and Grant Search US reserves the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with our defense. You may not settle any claim without Grant Search US's prior written consent. This indemnification obligation survives termination of these Terms and your use of the Services.

13. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of material changes via email and/or an in-platform notice at least 7 days before they take effect. For changes required by law, we may provide shorter notice. Material changes include (but are not limited to) changes to the arbitration agreement, limitation of liability, pricing, or your data rights.

Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the Platform and cancel any active subscription before the effective date.

Non-material changes (such as corrections, clarifications, or additions of new plan descriptions that do not reduce your rights) take effect immediately upon posting without prior notice.

13b. Service Modifications, Discontinuation & Data Backup

SERVICE MODIFICATIONS: Grant Search US reserves the right to modify, update, enhance, suspend, or discontinue any or all of the Services, features, or functionality at any time, with or without notice. We may impose limits on certain features or restrict access to parts or all of the Services without notice or liability. We are not obligated to maintain any specific feature, and the scope of available features may change over time.

SERVICE DISCONTINUATION: Grant Search US may discontinue the Platform or any Service entirely at any time in its sole discretion. In the event of a planned discontinuation, we will use commercially reasonable efforts to provide at least 30 days' notice to active subscribers (where feasible) via email and/or in-platform notice, and to provide a data export window so you can retrieve your content. No refund, credit, or compensation is owed for discontinuation except as explicitly stated in these Terms or in the Lifetime Plan terms (Section 6a).

DATA BACKUP DISCLAIMER: While Grant Search US implements industry-standard backup practices through our infrastructure provider, we do not guarantee that your data will not be lost, corrupted, or unrecoverable in all circumstances. You are solely responsible for maintaining your own backup copies of any content you upload to or create within the Platform. Grant Search US is not liable for any data loss arising from system failures, infrastructure outages, acts of God, or other events beyond our control. We recommend that you regularly export and store copies of your grant applications and documents on your own systems.

EMERGENCY SECURITY MEASURES: Grant Search US may, without prior notice, take any action we deem necessary to protect the security, integrity, or availability of the Platform, including: (a) temporarily restricting access to specific features; (b) resetting passwords or requiring re-authentication; (c) blocking IP addresses or geographic regions; (d) suspending accounts exhibiting suspicious activity; or (e) deploying emergency patches or configuration changes. We will use commercially reasonable efforts to restore normal service as soon as practicable.

API TERMS (Enterprise REST API): If you access the Platform via the Enterprise REST API, the following additional terms apply: (a) API access is governed by the rate limits and usage quotas specified in your Enterprise plan; (b) You must not abuse, overload, or use automated means to exceed rate limits; (c) API keys are confidential — you must not share, publish, or expose API keys in client-side code or public repositories; (d) Grant Search US may revoke or limit API access for misuse, excessive usage, or violation of these Terms; (e) The API is provided "as is" without any SLA or uptime guarantee except as specified in a signed Enterprise agreement; (f) You are responsible for all API calls made using keys issued to your account; (g) Grant Search US may deprecate or modify API endpoints with 90 days' notice. Misuse of the API may result in immediate revocation of access without refund.

THIRD-PARTY INTEGRATIONS: The Platform may integrate with third-party services including but not limited to Google Drive, Google Sheets, Google Calendar, Salesforce, HubSpot, Slack, Microsoft Teams, Outlook, DocuSign, Dropbox, Zapier, Make, QuickBooks, and Xero. These integrations are provided as a convenience and are subject to the terms of service, privacy policies, and availability of the respective third-party providers. Grant Search US does not control and is not responsible for the availability, accuracy, functionality, or security of any third-party service. Disruption of any third-party service does not constitute a failure of Grant Search US's Services and is not grounds for a refund or credit. You grant Grant Search US permission to access, store, and transmit your data through these integrations solely to provide the integration features to you.

14. Miscellaneous Legal Provisions

Entire Agreement. These Terms, together with our Privacy Policy, Cookie Policy, Refund Guarantee, and any applicable plan-specific terms, constitute the entire and exclusive agreement between you and Grant Search US, Inc. with respect to your use of the Services, and supersede and replace any and all prior or contemporaneous agreements, communications, representations, understandings, or negotiations, whether oral or written, regarding the same subject matter. You acknowledge that you have not relied on any statement, representation, assurance, or warranty (whether made innocently or negligently) that is not set out in these Terms. Any term or condition not expressly set forth herein shall have no force or effect.

CALIFORNIA CIVIL CODE § 1542 WAIVER: IF YOU ARE A CALIFORNIA RESIDENT, YOU HEREBY WAIVE THE BENEFIT OF CALIFORNIA CIVIL CODE SECTION 1542, WHICH PROVIDES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY." THIS WAIVER APPLIES ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Severability. If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force.

No Waiver. No failure or delay by Grant Search US in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy, nor shall any single or partial exercise of any such right, power, or remedy preclude any other or further exercise of that right, power, or remedy. No waiver of any provision of these Terms shall be effective unless in writing and signed by an authorized representative of Grant Search US, and any such waiver shall apply only to the specific instance and shall not constitute a continuing waiver.

Assignment. You may not assign or transfer your rights or obligations under these Terms without Grant Search US's prior written consent. Grant Search US may freely assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets, with notice to you. Any attempted assignment in violation of this section is void.

Force Majeure. Grant Search US shall not be liable for any failure, delay, or interruption in performance of its obligations under these Terms caused by events beyond its reasonable control, including but not limited to: natural disasters (earthquakes, floods, fires, hurricanes, tornadoes); pandemics, epidemics, or public health emergencies; acts of God; war, terrorism, or civil unrest; government actions, orders, or regulations; labor disputes, strikes, or lockouts; internet, telecommunications, or infrastructure failures; third-party API outages, disruptions, or deprecations (including but not limited to grants.gov, SAM.gov, NIH, NSF, Google, Stripe, or Base44/Payments infrastructure); cyberattacks, distributed denial of service (DDoS) attacks, or other malicious intrusions; power outages or utility failures; or any other event beyond Grant Search US's reasonable control. Grant Search US will use commercially reasonable efforts to resume performance as soon as practicable following any force majeure event. In no event shall Grant Search US be liable for any damages, losses, or liabilities arising from any force majeure event.

U.S. Government Users. If you are accessing the Services on behalf of a U.S. government entity, the Services are "commercial computer software" and "commercial computer software documentation" as those terms are used in 48 C.F.R. § 12.212.

Export Controls. You represent that you are not located in, under the control of, or a national or resident of any country subject to U.S. government embargo, and that you are not on any U.S. government restricted parties list.

15. International Users — Jurisdiction-Specific Rights

Grant Search US is operated from the United States. These Terms are governed by California law. However, if you are accessing the platform from outside the United States, the following additional terms apply to you.

EUROPEAN UNION & UK USERS (GDPR / UK GDPR): Your personal data is processed in the United States. By using this platform, you consent to that transfer. Under GDPR/UK GDPR, you have the right to: access your data, rectify inaccurate data, erase your data ("right to be forgotten"), restrict processing, data portability, and object to processing. To exercise these rights, contact privacy@grantsearchus.com. You also have the right to lodge a complaint with your national data protection authority (e.g., ICO in the UK, CNIL in France).

EU AI ACT (Regulation (EU) 2024/1689 — Effective August 2026): AI-generated content on this platform is produced by a general-purpose AI system. In accordance with Article 52 transparency obligations, we disclose that all grant narratives, eligibility analyses, scoring, and recommendations are AI-generated. This system is not classified as high-risk under Annex III. Human review before submitting any application is required.

AUSTRALIAN USERS (Australian Consumer Law — ACL): Our refund and cancellation terms are in addition to, and do not limit, your rights under the Australian Consumer Law (Competition and Consumer Act 2010, Schedule 2). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the ACL. To the extent of any inconsistency between these Terms and the ACL, the ACL prevails.

CANADIAN USERS (CASL / PIPEDA): We will only send commercial electronic messages to Canadian residents with express or implied consent as required under Canada's Anti-Spam Legislation (CASL), S.C. 2010, c. 23. Your personal information is handled in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA). You may withdraw consent to marketing communications at any time.

UK USERS (Consumer Contracts Regulations 2013): UK consumers have a 14-day cooling-off right from the date of purchase for digital services not yet begun. By requesting immediate access to our AI tools upon purchase, you explicitly acknowledge that performance of the contract begins immediately and that your right of withdrawal is extinguished once AI credits have been consumed. Where no credits have been consumed, UK users may request a refund within 14 days of purchase by contacting support@grantsearchus.com.

NEW ZEALAND USERS (Privacy Act 2020): You have rights under the New Zealand Privacy Act 2020, including the right to access, correct, and complain about the handling of your personal information. Contact privacy@grantsearchus.com to exercise these rights or to lodge a grievance. See our Privacy Policy Section 13a for full details.

JAPANESE USERS (APPI 2022): Your personal data is transferred to and processed in the United States, which does not have an APPI adequacy finding. By using Grant Search US, you consent to this cross-border transfer under APPI Article 24. You have the right to request disclosure, correction, and deletion of your personal information. Contact privacy@grantsearchus.com. See our Privacy Policy Section 13a for full details.

PAYMENT PROCESSING — PCI DSS & SCA NOTICE: All payment card data is collected and processed exclusively by Base44 Payments (Wix Payments), a PCI DSS Level 1 certified payment processor. Grant Search US does not store, process, or transmit payment card data and qualifies as a SAQ A merchant. All subscription prices are displayed in USD. UK and EU users: Strong Customer Authentication (3DS2/SCA) is handled automatically by our payment processor as required by the UK Payment Services Regulations 2017 and EU Payment Services Directive 2 (PSD2). No surcharges are applied to consumer card transactions — the price shown at checkout is the total price charged, in compliance with EU PSD2 and the UK Consumer Rights (Payment Surcharges) Regulations 2012.

INDIAN USERS (DPDP Act 2023): If you are located in India, your personal data is transferred to and processed in the United States. By using Grant Search US, you consent to this cross-border transfer pursuant to Section 16 of India's Digital Personal Data Protection Act 2023 (DPDP Act). You have the right to access, correct, and erase your personal data, and the right to grievance redressal. To exercise these rights or file a grievance, contact privacy@grantsearchus.com. We will respond within 30 days. See Section 13a of our Privacy Policy for full DPDP Act disclosures.

VAT / GST NOTICE FOR INTERNATIONAL SUBSCRIBERS: Subscription prices are displayed in USD (United States Dollars). If you are located in the European Union, United Kingdom, Australia, Canada, or another jurisdiction that imposes VAT, GST, or similar digital services tax on cross-border digital services, you are solely responsible for any applicable taxes unless Grant Search US is required by law to collect and remit them in your jurisdiction. Grant Search US does not currently collect VAT/GST on international subscriptions. We are monitoring applicable thresholds (EU: €10,000/year; UK: £85,000/year; AU: A$75,000/year; CA: C$30,000/year) and will implement tax collection when legally required. By completing your purchase, you acknowledge that Grant Search US has disclosed this limitation and that you bear responsibility for any applicable taxes on your subscription in your jurisdiction.

INTERNATIONAL GRANT DATA ATTRIBUTION: International grant data displayed on this platform is sourced from publicly available government and institutional sources (EU Horizon Europe, UKRI, World Bank Open Data, ADB, UN Grant Portal, and others) subject to their respective open data licenses. This data is provided for informational purposes only. Always verify grant details directly with the funding body before applying.
